Trends and Transitions in Registered Nursing Practice

Intentional Torts

Legal principles guide the manner in which certain professions including nursing need to conduct their undertakings. The tort law, which refers to as a wrongful act committed against an individual or their properly sans taking into consideration their contract, is one of the most significant legal principles in legal practice. Therefore, international torts, which are part of the tort laws, refer to willful acts that lead to the violation of another individual’s property or rights (Catalano, 2015). Intentional torts occur when a nurse deliberately sets to cause the consequences of the act; the actions of the nurse are intended to harm the client or their property; and when the act plays a fundamental role in causing the injury to the person or their property. Examples of intentional torts include intentional infliction of emotional distress, false imprisonment, assault, and battery.

Defamation of Character

Defamation of character is a component of quasi-intentional torts and harms the reputation of a person. The presence of defamation of character implies that a person’s reputation becomes injured via multifarious ways. Its presence means that the esteem of a person, his goodwill, respect, and the confidence that they enjoyed amongst their peers are diminished. Defamation of character can occur either as libel or slander wherein the former refers to written defamation while the latter refers to spoken defamation.

Electronic Pitfalls

 Electronic pitfalls refer to an invasion of privacy wherein breach of confidentiality and malpractice occurs due to technological failure. As a form of confidentiality violations, electronic pitfalls have increased in possibility due to the widespread adoption of telemedicine and computerized documentation (Catalano, 2015). Essentially, electronic pitfalls occur when medical records are lost due to computer failures, which lead to the violation of the HIPAA laws.

Malpractice

Malpractice is a form of negligence that can lead to professionals of the nursing profession being sued. It is a form of professional negligence that is not expected of nurses due to their status, which makes them to be held to a higher standard (Catalano, 2015). The standards that are created for nurses entails what a prudent and reasonable nurse would do if the situation was replicated. Failure to uphold them leads to malpractice.

Leadership Style

Leadership refers to the capacity of an individual to positively influence their peers. The influence depends on the leadership style that one will adopt depending on the prevailing circumstances. The leadership styles adopted in nursing are based on theories of leaderships, which provide a continuum of styles of leadership. These leadership styles range from passive to highly controlling approaches. Examples of leadership styles based on the leadership style theory include the laissez-faire style, the democratic and autocratic styles (Catalano, 2015). I have interacted with the laissez-faire style at my workplace when we are divided into groups led by one of us whose academic qualifications mirror ours. During such cases, the leaders have allowed us to perform tasks with freedom as long as we delivered the end-results. I have similarly worked under a democratic leader. Out nurse manager would always allow us to share in the decision-making concerning a hospital project. During such times, we are all allowed to give our views and perspectives right from the planning stage to the final one.

Factors that Affect Communication

Communication occurs in either nonverbal, paraverbal or verbal manner (Catalano, 2015). Whichever mode one adopts, there are certain things that can lead to the breakdown of communication, which factors are called blockers of communication. Therefore, factors such as the environment within which communication occurs, stress levels of the parties in communication, and change experiences and grief, as well as feelings of anger can block the presence of effective communication. Further factors that impact communication include acceptable greetings, tone, and the volume of voice. In a class system, the communication between those in upper and lower classes may be influenced by tradition (Giger, 2016). Thus, numerous factors impact the manner in which communication occurs.

Civility

 Civility in nursing forms one of the foundations of caring and is regarded as a moral imperative. Civility in the nursing profession enables one to consider caring as the focal point of their nursing practice. Exercising civility to all the parties that a nurse interacts
